This competition (the “Competition”) is operated by Notonthehighstreet Enterprises Ltd whose registered office is at NOTHS House, 63 Kew Road, Richmond TW9 2NQ (“notonthehighstreet”). This Competition starts at 9:00am on the 10th November 2022 GMT (the “Start Date”) and ends at 9:00am on 9:00am 14th November 2022 GMT (the “End Date”) (together the “Competition Period”).

By entering the Competition, you agree that your personal data will be used by notonthehighstreet to complete the Competition. If you win the Competition, you agree that your personal data will be used to announce you as the winner and used in order to send you the Prize (defined below). Any personal data collected by notonthehighstreet will be processed in accordance with notonthehighstreet’s privacy policy and your personal data (including Instagram handle and email address) will be passed onto Pasta Evangelists Limited (t/a Pasta Evangelists) for the sole purpose of Pasta Evangelists contacting you within the 7 days after the Winner Announcement Date (defined below) to remind you to create an account in order to redeem the Prize.

This Competition is in no way sponsored, endorsed or administered by Instagram, Facebook or any other social media channel, nor is Instagram, Facebook or any other social media channel associated with this Competition in any way. Eligibility

To be eligible to enter the Competition, you must:

• be 18 years or over; and
• be a UK resident; and
• have an active Instagram account during the Competition Period and at the Winner Announcement Date (defined below); and
• create an active Pasta Evangelists account no later than 7 days after the Winner Announcement Date (defined below); and
• have access to the internet.

Employees of notonthehighstreet are not eligible for entry into this Competition.

You may only enter the Competition once on notonthehighstreet’s Instagram post. More than one entry per post will be deemed as invalid.

How to Enter the Competition

To enter the Competition, you must

(i) On Instagram, be following @notonthehighstreet and @pastaevangelists during and throughout the Competition Period and at the Winner Announcement Date; and

(ii) like the Pasta Evangelists competition post on the notonthehighstreet Instagram page; and

(iii) comment on the notonthehighstreet Instagram post; and

(iv) if successful, the winner must create an account with Pasta Evangelists within 7 days of the Winner Announcement Date to receive the Prize

No purchase is necessary.

How the Competition Works

The Competition closes on the End Date. Any entries made in accordance with the Competition must be submitted during the Competition Period. Any entries made after the End Date shall be deemed invalid and therefore not considered.

Prize

There will be one (1) winner selected. 1 winner will be selected from Instagram entrants who are following both accounts and comment and like the post on notonthehighstreet’s or Pasta Evangelist’s social media channel. The winner will receive 1 x £200 notonthehighstreet gift voucher, 1 x Pasta Evangelist’s Ultimate Fresh Pasta Making Kit and 1 x Three Month Fresh Pasta Dishes E Gift Subscription for 1 person by Pasta Evangelists (the “Prize”).

The Prize is not transferable or returnable and has no cash alternative.

Notonthehighstreet must either publish or make available information that indicates that a valid award took place. To comply with this obligation, notonthehighstreet will send the surname and county of each prize winner and, if applicable, a copy of their winning entry, to anyone who emails [email protected] within one month after the relevant End Date. If you object to any or all of your surname, county and winning entry being published or made available, please contact notonthehighstreet at [email protected]. In such circumstances, notonthehighstreet must still provide the information and winning entries to the Advertising Standards Authority on request.

How the Winner is Selected

The winner will be chosen at random using a random number generator.

We will select the winner by 4pm on 14th November 2022 GMT (the “Winner Announcement Date”). The selected winner will be contacted via Instagram direct message within 24 hours of the Winner Announcement Date to confirm delivery details for the Prize and will need to provide a valid postal address and email address to notonthehighstreet in order to receive the Prize. All reasonable efforts will be made to contact the winner but if:

• a Prize is declined or unclaimed in part or in full including by not creating an account with Pasta Evangelists by no later than 7 days from the Winner Announcement Date; or

• a winner cannot be contacted or fails to respond, within 24 hours of being contacted,

then a replacement winner will be randomly selected from the same pool of entrants, using a random number generator, and will be notified on the same terms. The original winner will no longer be entitled to the Prize and their entry will then be forfeited.

Promises

When participating in this Competition you promise that:

(i) you will not upload, include any content that violates, or encourages any conduct that violates any law or regulation (including but not limited to any intellectual property rights), and any entry including any such material, will be invalid at notonthehighstreet’s sole discretion. Notonthehighstreet excludes any and all liability in respect of any such material; and

(ii) you will not act in any way which is rude or violent towards notonthehightstreet’s staff. Notonthehighstreet shall have the right, in its sole discretion, to exclude anyone from the Competition who acts in such a manner.

Limitation of Liability

Notonthehighstreet will not accept responsibility for competition entries that are lost, delayed in transit regardless of cause, including but not limited to, equipment failure, technical malfunction, network and computer hardware or software failure.

To the fullest extent permitted by law, notonthehighstreet will not under any circumstances be responsible or liable for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by notonthehighstreet’s negligence. Your statutory rights are not affected.

Notonthehighstreet’s rights

Notonthehighstreet reserves the right at any time to cancel, modify or supersede the Competition if, acting reasonably, the Competition cannot be conducted as specified.

Notonthehighstreet reserves the right to substitute a Prize for another Prize of equal value in the event that circumstances beyond its control make this unavoidable.

You agree that notonthehighstreet may make your entry available on its website (notonthehighstreet.com) and/or on its social media channels. You hereby grant notonthehighstreet a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the entry.

Governing Law

Any dispute arising from, or related to, these Terms and Conditions shall be subject to the laws of England and Wales, and shall be heard in the courts of England.
